Obama Deems American Veterans Unfit To Own Firearms

How would you feel if you received a letter from the U.S. Government informing you that because of a physical or mental condition that the government says you have it is proposing to rule that you are incompetent to handle your own financial affairs? Suppose that letter also stated that the government is going to appoint a stranger to handle your affairs for you at your expense? That would certainly be scary enough but it gets worse.

What if that letter also stated: “A determination of incompetency will prohibit you from purchasing, possessing, receiving, or transporting a firearm or ammunition. If you knowingly violate any of these prohibitions, you may be fined, imprisoned, or both pursuant to the Brady Handgun Violence Prevention Act, Pub.L.No. 103-159, as implemented at 18, United States Code 924(a)(2).”?

That makes is sound like something right from a documentary on a tyrannical dictatorship somewhere in the world. Yet, as I write this I have a copy of such a letter right in front of me. It is being sent by the U.S. Department of Veterans Affairs to hundreds, perhaps thousands, of America’s heroes. In my capacity as Executive Director of the United States Justice Foundation (USJF) I have been contacted by some of these veterans and the stories I am getting are appalling.


The letter provides no specifics on the reasons for the proposed finding of incompetency; just that is based on a determination by someone in the VA. In every state in the United States no one can be declared incompetent to administer their own affairs without due process of law and that usually requires a judicial hearing with evidence being offered to prove to a judge that the person is indeed incompetent. This is a requirement of the Fifth Amendment to the U.S. Constitution that states that no person shall “… be deprived of life, liberty, or property without due process of law…”.

Obviously, the Department of Veterans Affairs can’t be bothered by such impediments as the Constitution, particularly since they are clearly pushing to fulfill one of Obama’s main goals, the disarming of the American people. Janet Napolitano has already warned law enforcement that some of the most dangerous among us are America’s heroes, our veterans, and now according to this letter from the VA they can be prohibited from buying or even possessing a firearm because of a physical or mental disability.

Think about it, the men and women who have laid their lives on the line to defend us and our Constitution are now having their own Constitutional rights denied. There are no clear criteria for the VA to declare a veteran incompetent. It can be the loss of a limb in combat, a head injury, a diagnosis of PTSD, or even a soldier just telling someone at the VA that he or she is depressed over the loss of a buddy in combat. In none of these situations has the person been found to be a danger to themselves or others. If that was the case than all of the Americans who have suffered from PTSD following the loss of a loved one or from being in a car accident would also have to be disqualified from owning firearms. It would also mean that everyone who has ever been depressed for any reason should be disarmed. In fact, many of the veterans being deprived of their rights have no idea why it is happening.

The answer seems to be it is simply because they are veterans. At the USJF we intend to find the truth by filing a Freedom of Information Act request to the Department of Veterans Affairs to force them to disclose the criteria they are using to place veterans on the background check list that keeps them from exercising their Second Amendment rights. Then we will take whatever legal steps are necessary to protect our American warriors.

The reality is that Obama will not get all of the gun control measures he wants through Congress, and they wouldn’t be enough for him anyway. He wants a totally disarmed America so there will be no resistance to his plans to rob us of our nation. That means we have to ask who will be next. If you are receiving a Social Security check will you get one of these letters? Will the government declare that you are incompetent because of your age and therefore banned from firearm ownership. It certainly fits in with the philosophy and plans of the Obama administration. It is also certain that our military veterans don’t deserve this and neither do any other Americans.

    Enough is enough! odumdum needs to go. Brady Campaign needs to be ruled as unconstitutional and disbanded. UN certainly needs to get the hell out. They have no business in our country. obama is not one of us and needs to have all of his illegally obtained assets seized and then he can become a permanent resident of Guantanamo Bay. Hes trying to disarm the American people so all of his cronies can come invade us.

    Our veterans have made huge sacrifices and should not have their rights violated as well. They have received training and if you ask me are well within their means for owning and operating a firearm. Think of how many veterans there are. Now they’re trying to take guns away from trained veterans. These people are relentless and won’t rest until they have us under their control. (ie: unarmed and helpless)

    I certainly hope for our sake the American people as a whole will unite when the time comes to stop these people from taking us over.

    Any soldier (American or UN) opening fire on American citizens shall be treated as treasonous murderers to the state and its people and should be thrown in jail.

    Marty, I must agree with your analogy of a game of chess, there’s a lot of validity in that regard. But please, I’m begging you, do not believe for a moment the Veterans Affairs will not find a veteran incompetent and not turn their mental health condition over to the FBI.

    I’ve basically lost all respect for both parties, I guess that makes me an Independent, but I will not set here and allow anyone in any party violate my second amendment rights. It just happens to be the Commander in Chief is President Obama, he is currently the leader of this nation, he is in charge today, therefore he either leads this nation or let Congress impeach him and put a man/woman in his place to get the job done. This dividing the nation crap has got to stop!! Period!! Congress needs to be focused on a legal budget which we haven’t had for the last four years. $16T in debt, don’t get me started. This nation is being flushed, and there’s enough blame for both sides of the aisle, but I’m focused on where the buck stops, and that is the Oval Office.

    So the question to you Garry is have you received one of these so called letters. I am also a vet and have many veteran friends, and friends who work in the VA. Neither I, nor any friends have received such a letter, and none of my VA friends know of such a letter. So real proof would be nice. Anyone can create a document and say it’s being sent out.

    Wow, I support everything that I have seen on your site, until this!
    It appears to me that the VA is following up on a doctor’s concern about a patient. The patient and his family have obvious options:
    1) Hiring a financial manager, on their own, before the hearing.
    2) Responding to this letter with opposing information.
    In either case he can retain his 2nd amendment rights by submitting documentation that he is still competent with a firearm, even if he does not manage his money well.
    Think about this; If a person is malnourished and/or can’t buy their medications and has a gambling problem, a financial manager would be helpful. But, there is no reason that he should not hunt. However, if his problem is drugs or alcohol, maybe he shouldn’t be allowed to hunt.
    These are just 2 plausible scenarios. But, it looks to me like this letter is informing him that ‘due process’ is beginning.
    Also, I would imagine that he has other legal options. I would consult an attorney and even if if the hearing does not go his way, there should be an appeal process.

    I read your article, then I read the letter, then I re-read your article, my conclusion; you are an inflamatory douchebag. I am skeptical of most everything the current administration does, I’m a Libertarian, and I’m not stupid.
    I’m in 100% total agreement with Mike, this is clearly a form letter in response to a concern raised by someone in charge of this veteran’s care. We, the reader, have no way of knowing if the concerns are valid or not. In either case, the veteran in question is not being denied due process of law as you state. He/she is informed that they have 60 days from receipt of the letter to furnish proof of competency, and is being provided a hearing, with free legal council, and can bring as many witnesses as they want.
    There may well be something fishy going on with this case, but with the evidence provided, we can never know. No rights have been denied or violated, no one has been declared guilty or incompetent without a fair trial, and your wild speculations to the contrary do NOTHING to further the cause of second amendment/freedom supporters.
    I am as fervent a patriot as you will ever meet, but this diatribe(look up the definition of this fitting term) is only serving to further divide an already broken nation. We need people in your position to fight for us when things go awry, not stoke the fires unnecessarily and make up bullshit like this so you can play to ignorant people’s fears. You are a disgrace to your post and I sincerely hope you take my words to heart. You should thank the veterans for defending your right to spew retarded half-truths like this over the internet, instead, you do them a disservice by marginalizing their plight.

    Jason and Mike, the author of the article specifically says that the letter PROPOSES that the recipient is incompetent. He says that several times throughout the article, so please jump off of your high horses and read the damn article before you attack the author for saying things he didn’t. However, I agree with you both that it probably is a result of another legal matter happening with this veteran. There certainly could be extenuating circumstance, but the author is saying the people who have asked him for help have no idea why their competency is being questioned and I find that frightening. Where will it end? Will every person have to pass a legal test in oder to have a gun or maintain their own bank account? That’s the point.

    Wow! Well said! This is a time when every side should unite as citizens not by voting preferences or title but by citizenship! We are all being played against each other like a bunch of government lab rats and some can’t see that! Every person against the constitution or anything in it is considered a tyrant and traitor of the USA right? God bless the men and women risking their lives for us!     To all military members, for your information, the VA all ready has this policy in place. I’m a combat veteran with PTSD, and a back injury, the VA rated me incompetent, due to my PTSD. Veterans that have PTSD are rated on many differant levels. I was given a 60 days to respond to the VA board. I sent them my response and other documentation and it was ultimately turned down by the review board. I lost my rights as a 20 year military veteran to own guns or rifles what so ever. If you do not agree they hold your Compensation and Pension till you do. You are assigned a Federal Fiduciary to manage your money from your VA Pension and the VA tells you what you can spend your money on and what you can buy with it and what you can’t. If you buy something and don’t have there approval before purchase such as a car or real estate. They can refuse to pay for it, I bought a piece of real estate and it was like pulling teeth to get them to cover the payments when its my money. But your Fiduciary will tell you its not your money its the VAs money and they will use it in your best interest, which is a whole lot of BS. I’m sure there are good fiduciaries out there that look out for the veterans they are managing the funds for. But if you look online for Federal Fiduciaries for Veterans there are so many problems with the program that is already in place. Now they want to do it for all veterans not only the ones that have PTSD which is completely wrong. The whole damn process is wrong It is hard to fight.

    Ed your right, the VA already has this policy in place, Veterans are already being found incompetent, and there rights are being taken away. I’m one of those veterans it has happened to. Other Veterans have also lost there rights from being found incompetent, it cost a to much money to fight the system. You lose your 2nd Amendment rights and the rights to manage your own funds.

    I suggest that veterans not use the VA and if you do act as if you are doing just great. Try to use a private doctor, if possible. The government knows that veterans will not follow Unconstitutional orders and that they will fight back against tyranny. Wanna be dictators always find away to marginalize army vets as crazy.     I have an employee that has returned from Afghanistan within the last year and he has received a letter saying that he was determined to not be able to have a gun because he suffers PTSD. He had to go to the VA to dispute it. This is just another reason vets will be hesitant to get the help they need.
